Cancellation Policy and No show Policy

If you are LATE this is considered a NO SHOW if more than 5 minutes after your scheduled session time, unless agreed upon with CC Photography prior.

Photographer is under no liability or responsibility to make up for the clients lost time after client arrives late.

If event is canceled by the client, no portion of the fees paid to Consultant will be returned. If a wedding is canceled less than 6 months before date, 2nd deposit payment will be required to compensate for hours of service already rendered and loss of event date. If the wedding is postponed, services contracted can be applied to a new date if available (refer to Postponement Policy).

If you are a NO SHOW and you do not show up for your session or no call- you will not be rescheduled at any point in the future and CC Photography will keep any deposits or funds paid.

Events are including but not limited to weddings, private, or corporate events.

Newborns

Newborn sessions are on weekdays in the morning at around 10 days of age. No exceptions.

Liability

It is understood that Consultant is only liable for services completed and provided by Consultant and cannot be held liable for the services of other contracted vendors or other persons involved in the photo shoot. It is understood that in no event shall Consultant be liable for consequential damages of ANY kind. The consultant will not be held responsible for any medical concerns including but not limited to: allergies, adverse reactions, or intolerances to the consultant's props, glitter, fabrics, or animals that are included in the sessions. The consultant will not be held responsible for insects, spider bites, snake bites, and animal bites before, during, or after the session. It is the responsibility of the client to decide if they are willing to risk any allergies, reptile, or insect risks for the purpose of the photography session. The consultant will not be held responsible for any harm to the client(s) or their children in or around the studio space at 714 Marshall St Dexter, IA 50070. The consultant will not be held responsible for any trips or falls outside or inside of the studio space.

Retainer

An initial retainer of $50-$1000 will be required for a down payment and appointment reservation. I will inform you of what is required prior to booking. The retainer is non-refundable. The retainer does go towards your session's total amount due.

Unedited Digital Images

No unedited digital images will be released at any time for any album. Unedited digital images do not depict the true nature of the photographer's art and will not be released.

Altering of Images

No images released to the client or on social media shall be altered. Altering includes but is not limited to cropping the images, adding filters, or editing the images in any way. If the consultant becomes aware of any images altered the contract will be breached and the client will be expected to delete or remove any altered images. The photographer may choose to not continue to work with the client in the future.

Tagging and giving credit to the consultant

Any photo that is posted on social media shall tag CC Photography and/or give credit to CC Photography.

Copyright and Ownership of Images

The consultant is the only owner and copyright owner to the digital images released to clients and/or posted to social media. The consultant may give printing rights to the client only. The consultant may choose to post the client's photos to social media and/or art platforms. If the client refuses for photos to be posted to social media and/or art platforms a statement from the client will be required in writing and given to the photographer.

Models and Model Release

When a model is chosen to be used for marketing for CC Photography the model and/or model's parents if a minor give consent and must sign this contract in agreement that CC Photography can use any and all images taken for marketing purposes. This includes posts on social media, websites, and logos. The client gives up all rights for model photos and the consultant may use the images to represent the work of the consultant. In response to the model's time, the model will be given an agreed upon amount of free digital edited images. Minimum number agreed upon will be 5 images. Further images may be purchased from the consultant at $35 per digital edited photo.

Responsibility

Consultant is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will attempt to discuss options with the client to reschedule and a new deposit fee may be required. If the images are faulty or unable to be retrieved from SD card for any reason, the photographer will request a reshoot if possible, for the same or similar location, and length of time originally scheduled. No refunds will be automatically issued.

Contracted package

Includes all services described in selected package details reviewed and distributed to clients. Any additional services/products requested by the client incurred by consultant will be billed directly to client at cost. All services contracted cannot be deducted, but additional services can be added.

For your convenience, payments to Consultant can be made through the "Use session" link that you use to book.

Expiration

No expiration for this contract and terms of service.

Damage or Loss of Accessories for Weddings or Events

Client agrees to exercise all due care in caring for, and preserving the property of Consultant. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost.

Postponement Policy for Weddings or Events

If session is postponed, all services will cease at time of notification of postponement if no determined new date is provided. Payment schedule will be determined and readjusted post new event date notification. No refunds will be issued for full sessions or mini sessions due to rescheduling for severe weather, acts of God, or illness. If consultant agrees, the client may reschedule one time for mini sessions. For severe weather the day of a mini session, the consultant with contact the clients via email to update on cancellation or need to reschedule. If there is a need to reschedule due to severe weather client will have the option to schedule in any mini/petite event listed on Session website (that has an opening) or wait until the next weekend opening per consultant's schedule (Redfield and Strautmans tree farm ONLY). If client cancels and requires services to resume, post new event date being established, second deposit payment will be required at booking.

Overtime for Weddings or Events

Additional unplanned and/or un-contracted services (such as, but not limited to, full redo of design, day of event extension of time, services outside of scope of agreement, management of non event day activities, etc) are considered overtime and will be billed with prior notification and consent at the rate of $300 per hour.

Contracted Vendor and Payments

Any rentals and/or subcontracted vendors contracted on behalf of client will be paid in full to Consultant directly at requested deadline. Proper notice will be provided per cost.

Provided Documentation

All documentation created and provided to client is owned and copy written by Consultant and cannot be used or given to any other 3rd party without written permission from the consultant.

Costs

Any purchased items requested from client for day of event or prior will be billed directly to client at cost of goods and also mileage at $.60 per mile if extensive travel (beyond 40 miles) is required to be acquired.

To retrieve albums in archive 1 month or more after a session, a $50 archival fee will be added to your invoice for payment prior to delivery of archived images. If you choose to purchase a full album, please do so before or within 2 weeks of your session to prevent the fee.

Please note, some images and albums may be erased permanently, and are never guaranteed able to be archived.

For weddings, a meal and water must be available to the photographer at no cost. The photographer must be given sufficient time to eat the meal and drink water in between photographing the wedding and festivities. The photographer must be given time to sit for a break every 4 hours or as needed for at least 10 minutes.

Payment Schedule and Method

For your convenience, payments can be made online using the use session link provided to you. Otherwise, payment is to be made by cash. Checks must be agreed upon prior to the payment being due. $300 returned check fee will be required for any returned checks.

$50-1000 initial retainer due upon completion of the signed agreement for services. Remaining balance is due in full by the date of the event or the photography session.

Attorney

If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in additional to any other remedies to which that party might be legally entitled.

Turnaround time for and galleries:

The client will be informed of the timelines which are subject to change at any time. The full album will be emailed to you from Pixieset website within 2-4 weeks time from the date of the session. Please do not request or demand to decrease the time frame. If the need is urgent for an album to be completed it may be agreed upon to charge an express edit fee of $100+ per album. Please do not ask for status of editing or gallery prior to 2-4 week time frame. Wedding and event albums will take at least 8-12 weeks for editing.

CC Photography will choose the best images to edit and release in an album. CC Photography does not release all of the pictures taken to uphold the high standards and quality of the photos released. For mini sessions 8 digital edited photos are included in each album.

Events include up to 800 digital edited images with print release for 8 hours coverage.

Please review the editing style of CC Photography.

CC Photography will not change the editing style at the request of the client. CC Photography only edits minimally including the lighting, contrast, skin blemishes, and temperatures. Advanced editing at the request of the client will be outsourced for $40+ per image.

All sales are final, no refunds, no editing changes will be made after digital album is delivered.

I cannot always make your child smile, please be aware this may happen and it still makes for gorgeous photos. There will be no automatic refunds and no automatic re-takes of your session due to this.

Appropriate Conduct/ Safe Working Environment:

The Client(s) expressly agree(s) to take best efforts to provide Crystel Corbin/(CC Photography) with a safe and appropriate professional relationship. This includes only emails, texts, or messaging for correspondence. Please only call the vendor in the event of an emergency or a serious time-specific problem. Please only contact CC Photography during normal business hours including 8am-5pm Monday through Saturday. In the event of circumstances deemed to present a threat or implied threat of injury or unprofessional, harassing language or behavior to CC Photography owner or staff, CC Photography will take appropriate legal action. The Client(s) will agree to relieve and hold CC Photography harmless as a result of incomplete services under this Agreement, or for a lapse in the quality of CC Photography's work. The Client(s) shall be responsible for payment in full, regardless of whether the situation is resolved or whether CC Photography resumes work detailed in this Agreement.

All persons who book a session with CC Photography agree and acknowledge that you have read this contract, understand its terms, and agree to be bound thereby. Any additions, deletions, or revisions must be made in writing and approved by all responsible parties. The parties agree that this contract is the complete and exclusive statement of the mutual understanding of the parties.
